EU grants AIDP and ThreoTech exclusive rights to market magnesium L-threonate as Novel Food
The EU has authorized AIDP’s magnesium L-threonate to be used as a Novel Food. The product can now be used in consumer products, bringing a bioavailable option for magnesium supplementation.
The North American ingredient supplier adds that it has exclusive rights to the proprietary data used to authorize magnesium L-threonate. Only its partner ThreoTech, which sells the product under the brand name Magtein, and their sublicensees can market magnesium L-threonate in the EU for five years.
Other businesses can only market magnesium L-threonate during this period if they receive ThreoTech and AIDP approval, acquire a ThreoTech license and source the product from ThreoTech. Exceptions apply if a new authorization is granted without using the protected data, says the company.
Magtein is made to be used in products such as capsules, ready-to-drink beverages, snack bars, gummies, gels and powders.
A technical paper from AIDP and manufacturer Disproquima, explains Magtein improves memory, alleviates anxiety and helps to prevent cognitive decline. They claim it is the only magnesium compound that has been shown by two double-blind placebo-controlled studies to effectively raise the brain’s magnesium levels, which leads to enhanced learning abilities, working memory and short- and long-term memory.
Protecting exclusivity
ThreoTech has hired the international law firm Herbert Smith Freehills to help it take action against businesses in the EU that breach the exclusivity granted by the Novel Food approval.
AIDP warns any company currently selling magnesium L-threonate in the EU without a license must contact ThreoTech and immediately stop selling unlicensed products.

The EU has declared Magtein safe and bioavailable with full regulatory details available in Commission Regulation 2024/2694, including maximum magnesium levels in a corrigendum.
